At all times, including in connection with all uses of any of the Marks, in connection with the operation of the Franchised Business, and in connection with all dealings with customers, suppliers, public officials, the general public, and others, you will conspicuously indicate your status as an independent contractor, including in all contracts, advertising, publicity, promotional and other marketing materials, and on any signage and uniforms, and in the manner specified in the Operations Manual or as we otherwise may require.

What This Means (2025 FDD)

According to the 2025 Crepe De Licious Franchise Disclosure Document, franchisees must conspicuously indicate their status as independent contractors in all their business dealings. This includes all uses of the brand's marks, operation of the franchised business, and interactions with customers, suppliers, public officials, and the general public.

Specifically, Crepe De Licious requires franchisees to display their independent contractor status in all contracts, advertising, publicity, promotional and other marketing materials, and on any signage and uniforms. The Operations Manual or other directives from the franchisor will provide further specifications on how to properly indicate this status.

This requirement ensures that third parties understand that the franchisee is a separate legal entity from Crepe De Licious itself. This distinction is important for liability and legal reasons, as the franchisee is responsible for their own actions and obligations. By clearly communicating their independent status, franchisees avoid creating any impression that they are acting as agents of Crepe De Licious, which could lead to potential legal or financial complications for both parties.

Franchisees should carefully follow the guidelines provided in the Operations Manual and any additional instructions from Crepe De Licious to ensure they are meeting this requirement. Failure to properly indicate independent contractor status could result in a breach of the franchise agreement and potential penalties.
