What This Means (2025 FDD)
According to the 2025 Crepe De Licious Franchise Disclosure Document, franchisees are required to display the Marks and provide notice of trademark registration and claims in a specific manner. The FDD specifies that franchisees must display the Marks and give notice of trademark registration as "CREPE DE LICIOUS" or as otherwise required in the Operations Manual.
This requirement ensures that the franchisee acknowledges Crepe De Licious's ownership and rights to the Marks and protects the validity of the Marks. The franchisee cannot apply for governmental registration of the Marks or contest the registration status of the Marks. The franchisee's right to use the Marks is solely a nonexclusive license derived from the Franchise Agreement.
In practical terms, a prospective Crepe De Licious franchisee must adhere to the franchisor's guidelines for displaying the trademarks, service marks, and logos. This includes using the specified format and cooperating with Crepe De Licious to maintain registrations and protect their rights to the Marks. Failure to comply with these requirements could result in a breach of the Franchise Agreement and potential legal consequences.
