What This Means (2025 FDD)

According to the 2025 Crepe De Licious Franchise Disclosure Document, the franchisee is solely responsible for all employment decisions related to their Crepe De Licious restaurant, kiosk, or food truck. This includes hiring, firing, and training employees. The franchisee is also responsible for establishing remuneration, ensuring compliance with wage and hour requirements, setting personnel policies, providing benefits, maintaining records, supervising employees, and handling employee discipline.

Crepe De Licious emphasizes that all employees or independent contractors hired by the franchisee are exclusively the franchisee's employees or independent contractors and are not considered employees of Crepe De Licious for any purpose. The franchisor will not be held liable for any actions or settlements related to employment decisions made by the franchisee. The franchisee also agrees to inform their employees that they alone are their employer, and Crepe De Licious is not.

This arrangement is typical in franchising, where the franchisee operates as an independent business owner. While Crepe De Licious may offer advice or guidelines on employment policies, the franchisee is ultimately responsible for establishing and implementing their own policies in consultation with local legal counsel, particularly regarding employment law. This ensures compliance with local regulations and protects both the franchisee and franchisor from potential legal issues.

Prospective Crepe De Licious franchisees should understand that managing employees is a critical aspect of operating their franchise. They should be prepared to invest time and resources in recruiting, training, and supervising their staff to ensure efficient and compliant operations. Franchisees should also consult with legal and HR professionals to develop sound employment policies and practices.
