Does the Creative World School System Standards regulate the construction of the school?

- 11.02 Compliance with System Standards. You acknowledge and agree that your operation and maintenance of the School in accordance with System Standards are essential to preserve the goodwill of the Marks and all Schools. Therefore, at all times during the Term, you agree to operate and maintain the School in accordance with each and every System Standard, as we periodically modify and supplement them during the Term. System Standards may regulate any one or more of the following with respect to the School:
- (a) Construction, design, layout, decor, appearance, playground surface and playground equipment and lighting; periodic maintenance, cleaning and sanitation; periodic remodeling; replacement of obsolete or worn-out leasehold improvements, fixtures, furnishings, equipment and signs; periodic painting; and use of interior and exterior signs, emblems, lettering and logos, and illumination;

What This Means (2025 FDD)
According to Creative World School's 2025 Franchise Disclosure Document, the System Standards do regulate the construction of the school. Creative World School's System Standards can regulate construction, design, layout, decor, appearance, playground surface and playground equipment, and lighting. Franchisees must operate and maintain their schools in accordance with these System Standards, which Creative World School may modify or supplement over time.
The franchisee is responsible for developing the school, including leasing or purchasing land, building materials, and services. Franchisees must complete construction in accordance with Creative World School's System Standards and open the school within 12 months of the Construction Approval Date. The franchisee is responsible for preparing construction plans and specifications that suit the site's shape and dimensions and comply with applicable ordinances, building codes, permit requirements, and lease restrictions.
Before construction begins, franchisees must submit these plans to Creative World School for approval. Creative World School will provide prototype design plans, specifications, decor, and layout, including requirements for design, color scheme, image, interior and exterior layout, playground and parking layout, and operating assets. Creative World School's approval of construction plans means the plans meet their minimum standards and specifications for the school's construction and timing of construction. However, this approval does not indicate whether the plans meet legal requirements like the Americans with Disabilities Act (ADA).
