What This Means (2025 FDD)

According to the 2025 Creative World School FDD, any disputes that are not resolved through mediation will be submitted for arbitration to the office of the AAA (American Arbitration Association) closest to Creative World School's headquarters in Bonita Springs, Florida. The FDD does not specify the exact location of that AAA office. However, the arbitration proceedings themselves will be conducted at Creative World School's headquarters in Bonita Springs.

This means that if a franchisee has a dispute with Creative World School that cannot be resolved through mediation, the franchisee will be required to participate in arbitration. While the actual arbitration hearings will take place at the headquarters, the selection of the arbitrator will be done in accordance with AAA procedures. The arbitrator selected must be a retired federal court judge.

The arbitrator has the authority to award various forms of relief, including monetary damages with interest, specific performance, injunctive relief, and reimbursement of attorney's fees and related costs to the prevailing party. All parties involved in the arbitration must also sign a confidentiality agreement, with exceptions only for disclosures and filings required by law.

Prospective franchisees should consider the implications of this arbitration clause, including the location of the closest AAA office and the potential costs and benefits of resolving disputes through arbitration rather than litigation. Franchisees should also be aware that any arbitration will be conducted on an individual basis and not as part of a class action.
