What This Means (2025 FDD)

According to the 2025 Creative World School FDD, Creative World School owns all copyrights and intellectual property rights to the art displayed at the school. As a franchisee, you are not allowed to let any art become a fixture of the school without written permission from Creative World School. Additionally, you cannot display or use any art in any competitive business.

If a franchisee commissions art for their school, they are responsible for ensuring the artist assigns all rights, title, and interest in the art to Creative World School. If such an assignment is not possible, the franchisee must obtain an unconditional, royalty-free, worldwide, multi-site, multi-user, irrevocable, and freely assignable license for Creative World School to use, license, modify, reproduce, and make commercial and derivative use of the art. The franchisee must ensure that all individuals claiming intellectual property rights to the art sign the necessary assignments or licenses designated by Creative World School before the art is commissioned, utilized, purchased, or licensed.

Creative World School retains title to all art, and the franchisee cannot claim ownership or grant any security interest or lien on the art. The franchisee is responsible for discharging any liens asserted against the art, except those imposed by Creative World School. Unauthorized use of the Creative World School marks constitutes a breach of the franchise agreement and an infringement of Creative World School's rights. The franchisee's use of the marks and any goodwill established by such use will exclusively benefit Creative World School, and the agreement does not confer any goodwill or other interests in the marks to the franchisee, other than the right to operate the school in compliance with the agreement.
