What This Means (2025 FDD)

According to Cream's 2025 Franchise Disclosure Document, Cream acknowledges that complete uniformity across all franchise locations may not always be possible or practical due to varying conditions. Therefore, Cream reserves the right to vary System Standards for a franchise owner. This decision is based on conditions that Cream considers important to the franchise owner's successful operation or to preserve the goodwill of the Cream system and its trademarks.

This means that Cream has the discretion to make exceptions to its standard operating procedures and requirements for individual franchisees. These variations could be related to the location of the franchise, local market conditions, or other factors that Cream believes could impact the franchisee's success. However, the FDD also states that Cream is not obligated to offer similar variations or accommodations to other franchise owners.

For a prospective Cream franchisee, this clause offers both potential benefits and risks. On one hand, it suggests that Cream is willing to be flexible and adapt to the unique circumstances of each franchise. On the other hand, it also means that Cream has the sole discretion to decide when and how to vary System Standards, and there is no guarantee that a franchisee will receive the same accommodations as others. It would be prudent for a potential franchisee to discuss specific situations where variations to System Standards might be beneficial for their location during the due diligence process.
