Under what conditions will the Cream franchisor charge a fee for the Initial Training Program?

atisfaction and do not expressly and promptly request additional training after completion of the Initial Training Program, then you and they will be deemed to have been trained sufficiently to operate a Jeni's Ice Creams Scoop Shop.
We may charge you our then-current fee for the Initial Training Program if: (a) you request that more than three persons attend the Initial Training Program for your first Jeni's Ice Creams Scoop
Shop, and we approve such persons to attend; (b) we provide any portion of the Initial Training Program more than once to accommodate your attendees; and/or (c) you request and/or we require that your Mandatory Trainees attend the Initial Training Program for the second or subsequent Jeni's Ice Creams Scoop Shop you develop. As of the Effective Date, our fee for the Initial Training Program is $1,000 per attendee, but we may modify this fee by up to 10% per year on a compounding basis. We may also deny your request for additional attendees at the Initial Training Program, other than the Mandatory Trainees for your first Jeni's Ice Creams Scoop Shop, for any reason.
B. PERSONNEL TRAINING.
You have the ultimate and exclusive responsibility for ensuring that all of your employees and personnel, including any Shopkeeper(s), are appropriately trained to operate your Shop in accordance with this Agreement and our System Standards, regardless of any training or support that we provide. We may periodically establish certain minimum requirements for your employee training programs, including that we may require that your Mandatory Trainees and/or other personnel complete a nationally recognized health certification course. If you engage any new Shopkeeper(s) during the Term, we may require that such person(s) satisfactorily complete a training program we have approved before providing services at your Shop. If we do not approve you to offer training to Shopkeeper(s), and/or you are at any time not in compliance with our System Standards, we may require such Shopkeeper(s) complete our then-current Initial Training Program, and we may charge our then-current training fee for the Initial Training Program.

What This Means (2025 FDD)
According to Cream's 2025 Franchise Disclosure Document, Cream may charge a fee for the Initial Training Program under certain circumstances. Specifically, Cream may charge a fee if the franchisee requests that more than three people attend the initial training program for their first Jeni's Ice Creams Scoop Shop, and Cream approves the additional attendees. Cream may also charge a fee if they provide any portion of the initial training program more than once to accommodate the franchisee's attendees. Additionally, Cream may charge a fee if the franchisee requests or Cream requires mandatory trainees to attend the initial training program for a second or subsequent Jeni's Ice Creams Scoop Shop.
As of the effective date of the FDD, the fee for the Initial Training Program is $1,000 per attendee. However, Cream retains the right to modify this fee by up to 10% per year on a compounding basis. Furthermore, Cream may deny a franchisee's request for additional attendees at the Initial Training Program, other than the mandatory trainees for the first Jeni's Ice Creams Scoop Shop, for any reason.
Cream also states that if a franchisee engages any new Shopkeepers during the term of the agreement, Cream may require that such persons satisfactorily complete a training program Cream has approved before providing services at the shop. If Cream does not approve the franchisee to offer training to Shopkeepers, and/or the franchisee is at any time not in compliance with Cream's System Standards, Cream may require such Shopkeepers to complete Cream's then-current Initial Training Program, and Cream may charge their then-current training fee for the Initial Training Program. The franchisee is responsible for paying all expenses, including wages, transportation, food, lodging, and workers' compensation insurance, incurred by the franchisee and their mandatory trainees or any other personnel during any meetings and/or training courses and programs that Cream provides during the term, including the Initial Training Program and/or any ongoing programs, courses, and/or training.
