What This Means (2025 FDD)
According to Cream's 2025 Franchise Disclosure Document, a franchisee must pay a transfer fee of $25,000 to Cream when transferring their franchise. This fee is required whether the franchisee is transferring the franchise agreement itself or the Cream shop.
However, there is an exception to this transfer fee. No transfer fee is due if a deceased owner transfers the franchise to their surviving spouse, provided that the transfer otherwise complies with the terms and conditions outlined in Section 4 of the franchise agreement. Even in the case of a transfer to a surviving spouse, the franchisee is responsible for reimbursing Cream for any direct costs incurred while documenting and processing the transfer, including reasonable legal fees.
Additionally, if a franchisee transfers their agreement to a wholly-owned entity, Cream will not require payment of the $25,000 transfer fee. However, the franchisee is still responsible for reimbursing Cream for any direct costs incurred while documenting and processing the transfer, including reasonable legal fees.
