What This Means (2025 FDD)

According to the 2025 FDD, if you transfer your Cream franchise, the individuals who are required to complete training under the franchise agreement must satisfactorily complete Cream's training program. The transferee is responsible for paying all costs and expenses that Cream incurs to provide the training program to these individuals.

In addition to the training requirements, the transferee must also meet other conditions to be approved. The transferee must meet Cream's application and certification requirements. The transferee must not have an ownership interest in or perform services for a competitive business. The transferee may also need to sign Cream's current form of franchise agreement and related documents, which may differ significantly from the original agreement, including royalty fees and brand fund contributions. The transferee might also need to sign a guaranty undertaking to be bound by the agreement and provide an updated Attachment A.

These requirements ensure that the new Cream franchisee is adequately prepared to operate the franchise according to Cream's standards and that Cream maintains control over its brand and operations. Prospective franchisees should carefully consider these requirements and the associated costs when evaluating the transfer of a Cream franchise.
