Can Cream require Mandatory Trainees to attend ongoing training courses and certification programs?

may discontinue and modify from time to time. As of the Effective Date, our additional training fee is $500 per trainer per day. We may modify the amount of our per day additional training fee by up to 10% per year on a compounding basis.
We may periodically during the Term require that your Mandatory Trainees attend and satisfactorily complete various ongoing training courses and/or certification programs at the times and locations that we designate, including courses and programs provided by us, our affiliates, our representatives, or other third-parties we designate. We may also require you (or if you are an Entity, your Principal Owner) and your Shopkeeper attend an annual meeting of franchise owners at the location we designate. If we host such a conference (which we are not obligated to do), you must pay our then-current conference fee (up to $1,500 per person) for you (or if you are an Entity, your Principal Owner) and your Shopkeeper, regardless of whether such persons attend the conference.
Notwithstanding any provision in this Agreement to the contrary (including our obligations related to operations support, inspections, training, or otherwise), we will not be required to send any of our personnel and/or representatives to your Shop to provide any services in person if, in our sole determination, it is unsafe to do so. Such determination by us will not relieve you from your obligations under this Agreement and will not constitute a default of this Agreement by us.

What This Means (2025 FDD)
According to Cream's 2025 Franchise Disclosure Document, Cream may require Mandatory Trainees to attend and satisfactorily complete ongoing training courses and certification programs. These courses and programs can be provided by Cream, its affiliates, representatives, or other third parties that Cream designates. Cream determines the times and locations for these training events.
Cream also has the option to require the franchisee (or, if the franchisee is an entity, the Principal Owner) and the Shopkeeper to attend an annual meeting of franchise owners at a location Cream designates. While Cream is not obligated to host such a conference, if they do, the franchisee must pay a conference fee of up to $1,500 per person for themselves (or the Principal Owner) and their Shopkeeper, regardless of whether they attend.
Franchisees are responsible for covering all expenses incurred during any meetings, training courses, and programs provided by Cream, including wages, transportation, food, lodging, and worker's compensation insurance for themselves, their Mandatory Trainees, and any other personnel. Cream may also require that Mandatory Trainees and/or other personnel complete a nationally recognized health certification course.
