This AREA DEVELOPMENT AGREEMENT (this "Agreement") is made and entered into by and between JENI'S SPLENDID ICE CREAMS FRANCHISE, LLC, an Ohio limited liability company with its principal business address at 401 North Front Street, Suite 300, Columbus, Ohio 43215 ("we"), and the developer indicated on the first page of this Agreement ("you"), as of the date signed by us and set forth below our signature on this Agreement (the "Effective Date").

What This Means (2025 FDD)
According to Cream's 2025 Franchise Disclosure Document, the Area Development Agreement is made between Jeni's Splendid Ice Creams Franchise, LLC, referred to as "we," and the developer, referred to as "you," who is indicated on the first page of the agreement. This agreement grants the developer certain rights and imposes obligations related to developing and operating Cream locations within a specific geographic area.
Cream, as the franchisor, grants the developer the right to develop, own, and operate a specified number of Cream Scoop Shops within a defined Development Area, as detailed in Attachment A. The developer, in turn, agrees to diligently perform their obligations under the agreement and fully exploit these development rights during the term of the agreement.
The agreement specifies that the term begins on the Effective Date and continues until either the last required Cream Scoop Shop opens or the last day of the final Development Period, as outlined in the Development Schedule. The developer cannot extend the term of the agreement without Cream's approval.
