What This Means (2025 FDD)

According to Cream's 2025 Franchise Disclosure Document, Cream's approval of the opening date is required. The franchisee must satisfy all of Cream's system standards for developing and opening their shop and open for business by the earlier of two dates: 8 months after signing the lease or the first anniversary of the effective date of the franchise agreement. Cream must approve the date that the franchisee opens their shop for business, referred to as the "Opening Date," and the franchisee cannot open their shop without Cream's express approval.

This requirement gives Cream significant control over the launch of each franchise location. By mandating approval, Cream ensures that each shop meets its standards before commencing operations. This oversight helps maintain brand consistency and protect Cream's reputation.

For a prospective franchisee, this means that simply meeting the deadlines for development and construction is not enough. The franchisee must also obtain explicit approval from Cream before opening. This could involve inspections, final training sign-offs, or other requirements Cream deems necessary. Failure to obtain this approval could result in delays or even a breach of the franchise agreement. Cream also has the right to terminate the agreement if the franchisee does not obtain approval prior to opening their shop.

Cream's approval process is a critical step in the franchise launch, ensuring that all locations meet brand standards and are ready to represent the Cream brand effectively. Franchisees should factor this approval process into their timelines and maintain open communication with Cream to ensure a smooth and timely opening.
