If I want to obtain an additional Cream franchise location and I do not have an Area Development Agreement, what agreement must I enter into?
Cream Franchise · 2025 FDDAnswer from 2025 FDD Document
Unless you have signed an Area Development Agreement to develop multiple Jeni's Ice Creams Scoop Shops under the terms and conditions contained in that Area Development Agreement, we do not grant any options, rights of first refusal, or similar rights to obtain additional franchises. If you wish to obtain an additional franchise location, you must enter into a separate Franchise Agreement for that location.

What This Means (2025 FDD)
According to Cream's 2025 Franchise Disclosure Document, if you wish to obtain an additional franchise location and you do not have an existing Area Development Agreement, you must enter into a separate Franchise Agreement for each additional location. Cream does not grant any options, rights of first refusal, or similar rights to obtain additional franchises unless an Area Development Agreement is in place.
This means that each Cream franchise is treated as a separate business venture unless you have secured the rights to develop multiple locations through an Area Development Agreement. Without this agreement, you cannot assume you have any priority or guaranteed opportunity to expand your Cream business.
For prospective franchisees, this highlights the importance of understanding the growth strategy from the outset. If your goal is to own multiple Cream locations, it is essential to explore the possibility of an Area Development Agreement early in the process. Otherwise, securing additional locations will depend on Cream's willingness to grant you another franchise agreement at that time, competing with other potential franchisees.
