What This Means (2025 FDD)

According to the 2025 Cream Franchise Disclosure Document, Cream franchisees are not prohibited from reporting a suspected violation of law to a governmental agency. The franchise agreement specifically states that nothing within the agreement prevents a franchisee from reporting a suspected violation of law to the appropriate governmental agency or authority. This clause protects the franchisee's right to report any illegal activities without fear of reprisal from Cream.

This provision is included within a section regarding non-disparagement, which generally restricts franchisees from speaking negatively about the Cream brand. However, the exception for reporting suspected legal violations ensures that franchisees can fulfill any legal or ethical obligations to report misconduct. This clause applies both during and after the term of the franchise agreement, offering continued protection to former franchisees as well.

This type of clause is increasingly common in franchise agreements to comply with whistleblower protection laws and to encourage ethical behavior within the franchise system. It allows franchisees to act as responsible corporate citizens without risking their franchise investment. Prospective franchisees should view this as a positive aspect of the Cream franchise agreement, as it aligns with principles of transparency and legal compliance.
