What This Means (2025 FDD)

According to Cream's 2025 Franchise Disclosure Document, the specific guidelines for displaying Cream's trademarks and service marks (the "Marks") are detailed in the Brand Manual. As a franchisee, you are granted a limited, non-exclusive license to use these Marks during the term of your Franchise Agreement, but this usage must strictly adhere to the terms outlined in the agreement and Cream's System Standards.

The Brand Manual serves as the primary resource for understanding the approved style and graphic presentation of the Marks. Franchisees are required to use and display the Marks in the exact manner described in this manual. Deviation from these standards is not permitted, and franchisees are prohibited from using any other trademarks, service marks, or commercial symbols unless explicitly authorized by Cream in writing.

This requirement ensures brand consistency across all Cream franchise locations, maintaining a uniform image and customer experience. It also protects Cream's trademarks by preventing unauthorized or incorrect usage that could dilute the brand or create customer confusion. Franchisees must adhere to these guidelines in all aspects of their shop's presentation, including signage, advertising, and promotional materials.

Furthermore, franchisees must also adhere to the guidelines set forth in the Brand Manual for any digital presence. Cream may modify the Marks and System over time, and franchisees are obligated to implement these changes as directed by Cream. While franchisees are responsible for local advertising, they must ensure that all advertising adheres to Cream's System Standards, including the proper use of the Marks.
