You must ensure that your Shop is designed and constructed in all respects in accordance with the Construction Plans we have approved. You must also, at your cost, to do all things necessary to develop and prepare your Shop for opening in accordance with your Franchise Agreement and our System Standards.

According to the 2025 FDD, a Cream franchisee is responsible for ensuring that their shop is designed and constructed in accordance with the Construction Plans approved by Cream. After Cream approves the lease, the franchisee must apply for the necessary permits and local licenses to complete the construction outlined in the Construction Plans. The franchisee is responsible for conforming the premises to local ordinances and building codes, obtaining the required permits, and constructing, remodeling, decorating, and outfitting the premises to meet Cream's specifications.
The franchisee cannot modify the Construction Plans without Cream's approval. The franchisee must also take all necessary actions to develop and prepare the shop for opening, in accordance with the Franchise Agreement and Cream's System Standards. The opening date depends on several factors, including obtaining approvals for the premises, Construction Plans, and lease, securing necessary permits and licenses, constructing the shop according to approved plans and standards, and acquiring all required fixtures, equipment, signage, décor, inventory, and supplies.
Cream estimates that the shop will begin operating within eight months after the lease is executed or by the first anniversary of signing the Franchise Agreement. Failure to open the shop by these deadlines may result in the termination of the Franchise Agreement. The franchisee is also responsible for ensuring that all employees are appropriately trained to operate the shop according to the Franchise Agreement and Cream's System Standards.
