What This Means (2025 FDD)

According to Cream's 2025 Franchise Disclosure Document, Cream can deny a transfer if the transferee or its owners have an interest in or perform services for a Competitive Business. Specifically, Cream requires that neither the transferee nor its owners (if the transferee is an Entity) or affiliates have an ownership interest in or perform services for a Competitive Business as part of the application and certification requirements for transfer approval.

This condition ensures that the incoming franchisee is fully committed to the Cream brand and will not divert resources or knowledge to a competing business. It protects Cream's market position and proprietary information by preventing potential conflicts of interest.

For a prospective franchisee, this means that if you plan to sell your Cream franchise, the potential buyer and their owners must not have any existing involvement with competing ice cream businesses. This requirement could limit the pool of potential buyers and may affect the sale price or terms of the transfer. It is crucial to ensure that any prospective transferee meets this condition to avoid denial of the transfer by Cream.
