You must satisfy all of our System Standards for developing and opening your Shop and open your Shop for business by the earlier of: (i) 8 months after you sign the Lease, or (ii) the first anniversary of the Effective Date. We must approve the date that you open your Shop for business (the "Opening Date") and you will not open your Shop without our express approval.

What This Means (2025 FDD)

According to Cream's 2025 Franchise Disclosure Document, a franchisee must open their shop for business by the earlier of two deadlines: 8 months after signing the lease or on the first anniversary of the Effective Date. The Effective Date is the date the franchise agreement is signed. Therefore, the franchisee has a maximum of one year from the Effective Date to open their Cream shop.

Cream also requires approval of the opening date. The franchisee cannot open their shop without express approval from Cream. This means that in addition to meeting the deadlines, the franchisee must also coordinate with Cream to ensure the opening date is approved.

Failure to meet these deadlines or to obtain Cream's approval could result in a breach of the franchise agreement. Cream retains the right to terminate the agreement if the franchisee does not open the shop by the specified deadline, as detailed in Section 2.C of the franchise agreement.
