What This Means (2025 FDD)

According to Cream's 2025 Franchise Disclosure Document, the Brand Fund can be used to support charitable organizations. Cream has established a brand promotion fund (the "Brand Fund") to administer advertising, marketing, and public relations programs. Cream has exclusive control over the Brand Fund's programs and services, including the creative concepts, materials, campaigns, geographic market, media placement, and allocation.

Specifically, the Brand Fund may pay for sponsoring, supporting, and/or donating proceeds to one or more charitable, social, or community organizations or initiatives and/or hosting campaigns, initiatives, and/or events for the foregoing. Cream may also establish national or local charitable, social, or community events and initiatives for Jeni's Ice Creams Scoop Shops, and franchisees must participate in these events and initiatives in accordance with Cream's System Standards. This may include donating some or all of the Net Sales derived from certain events (together, "Ice Cream Socials") to national or local charitable, social, and/or community organizations that Cream has approved or designated.

Individual Cream franchisees are also expected to support charitable, social, and community organizations and causes in their local areas that are consistent with Cream's System and System Standards. However, franchisees must obtain Cream's express written approval of all organizations, initiatives, and causes that their Shop will support and/or will be marketed from their Shop and/or to customers of their Shop. Franchisees may not use their Shop, Cream's Marks, and/or Cream's System in any manner to promote any organization, charity, cause, and/or platform that Cream has not expressly approved, and/or that Cream has disapproved. This ensures that all charitable activities align with Cream's overall brand and values.
