According to Cream's 2025 Franchise Disclosure Document, franchisees are explicitly prohibited from making unauthorized copies of Cream's Confidential Information. The FDD emphasizes that all Confidential Information is owned by Cream or its affiliates and is disclosed to franchisees only on the condition that they protect it. Unauthorized use or disclosure is considered an unfair method of competition and a breach of trust, which could result in irreparable harm to Cream.
Cream requires franchisees and their personnel to process, retain, use, collect, and disclose Confidential Information strictly to the extent necessary for operating their Cream shop. This information must be handled in accordance with Cream's privacy policies and System Standards. Franchisees are responsible for ensuring that anyone they share Confidential Information with, such as employees, also adheres to these requirements.
To prevent unauthorized use or disclosure, Cream mandates that franchisees adopt and maintain administrative, physical, and technical safeguards. These safeguards include establishing reasonable security and access measures, restricting disclosure to key personnel, and requiring individuals with access to sign confidentiality agreements. Franchisees must also destroy or return any Confidential Information at Cream's request. The FDD specifies that confidential information does not include information already lawfully known to the public.
