What This Means (2024 FDD)
Based on the 2024 Crawlspace Medic Franchise Disclosure Document, the document does not explicitly state who is responsible for the cost and expense of delivering the Manual and other materials to Crawlspace Medic upon termination or expiration of the Franchise Agreement. However, the FDD does state that upon termination or expiration of the agreement, the franchisee must cease using the Marks and copyrighted material.
Item 22 of the FDD discusses obligations of the franchisee upon termination or expiration of the agreement. It states that all rights and licenses granted to the franchisee immediately terminate, and the franchisee must cease operating the franchised business and using any Crawlspace Medic intellectual property. This implies the franchisee must discontinue use of the manual and other materials, but it does not specify the return of these materials or the associated costs.
A prospective franchisee should clarify with Crawlspace Medic the specific procedures for handling the operations manual and other proprietary materials upon termination or expiration of the franchise agreement. This includes understanding whether the franchisee is required to return these materials, and if so, who bears the responsibility for the associated costs and expenses.
