What This Means (2024 FDD)
According to the 2024 Crawlspace Medic Franchise Disclosure Document, permanent disability is defined within the context of the Development Agreement. Specifically, it refers to a mental or physical condition that is reasonably expected to prevent, or actually does prevent, the developer from continuously supervising the development and operation of their Crawlspace Medic outlets for at least six months from the onset of the condition.
This definition is important because it triggers certain provisions within the agreement regarding the transfer of development rights. If a developer experiences such a disability, their rights under the agreement will terminate unless prohibited by applicable law. If such a termination is prohibited, the developer's representative (executor, administrator, etc.) must transfer the developer's interest in the agreement to a Franchisor-approved third party within six months of the disability.
This clause ensures that the Crawlspace Medic business continues to be actively managed and developed, even in unforeseen circumstances. It also protects the interests of both the franchisor and the franchisee by providing a clear process for handling situations where the developer is no longer able to fulfill their obligations. Prospective franchisees should carefully consider this provision and understand the implications of a long-term disability on their ability to operate and develop their Crawlspace Medic outlets.
