Answer from 2024 FDD Document

We reserve the right to substitute different Marks if we can no longer use the current Marks, or if we determine that substitution of different Marks will be beneficial to the System. In such event, we may require you, at your expense, to modify or stop using any Mark, including the Principal Mark, or to use one or more additional or substitute Marks.

What This Means (2024 FDD)

According to Crawlspace Medic's 2024 Franchise Disclosure Document, the decision to substitute different marks, and the determination of whether such a substitution would be beneficial to the Crawlspace Medic system, rests with the franchisor. Specifically, Crawlspace Medic reserves the right to make these substitutions if they can no longer use the current marks or if they believe a change would improve the overall system.

This is a significant point for potential franchisees because it means Crawlspace Medic has the authority to change the branding elements under which a franchisee operates. If Crawlspace Medic decides to substitute marks, they may require the franchisee to modify or stop using any mark, including the principal mark, and to use one or more additional or substitute marks. The franchisee is responsible for the expense of these changes.

This clause protects Crawlspace Medic by allowing them to adapt their branding as needed, whether due to legal challenges or marketing strategy shifts. However, it also places a financial burden and operational uncertainty on the franchisee, who must be prepared to rebrand their business at their own cost if Crawlspace Medic deems it necessary. Franchisees should consider the potential costs and disruptions associated with rebranding when evaluating this franchise opportunity.
