What This Means (2024 FDD)
According to the 2024 Crawlspace Medic Franchise Disclosure Document, upon termination or expiration of the franchise agreement, a franchisee must immediately cease operating the franchised business. Furthermore, the franchisee (and any principals involved) must not directly or indirectly present themselves as a current Crawlspace Medic owner, franchisee, or licensee. This prevents any potential confusion among customers or the public regarding the franchisee's affiliation with the Crawlspace Medic brand after the agreement ends.
In addition to ceasing operations and disassociating from the brand, the franchisee must immediately and permanently stop using Crawlspace Medic's trademarks (the Marks), designs, copyrighted material, intellectual property, and any confidential or proprietary information. They are also prohibited from using any trade names, service marks, or commercial symbols that could suggest an association with Crawlspace Medic, its licensor, or its system. This includes, but is not limited to, removing all signs, billboards, advertising materials, displays, stationery, forms, and any other items displaying the Crawlspace Medic Marks.
These post-termination obligations are standard in franchising to protect the brand's integrity and prevent unfair competition from former franchisees. By enforcing these restrictions, Crawlspace Medic ensures that customers continue to associate the brand with its current franchisees who are operating under the established standards and guidelines. A prospective franchisee should carefully consider these obligations and understand the implications of ceasing all operations and brand association upon termination or expiration of the franchise agreement.
