What does Crawlspace Medic claim copyrights in?

According to Crawlspace Medic's 2024 Franchise Disclosure Document, Crawlspace Medic, LLC claims copyrights on certain material used in its system. This includes, but is not limited to, its website, documents, project designs, advertisements, promotional materials, and the Manual. Crawlspace Medic claims these copyrights whether or not they have been officially filed with the U.S. Copyright Office. These copyrights, along with trademarks, trade secrets, service marks, trade dress, and proprietary systems, are collectively referred to as the "Intellectual Property."

As a Crawlspace Medic franchisee, it's important to understand that you are granted the right to use this Intellectual Property, including the copyrighted materials, strictly in accordance with the terms and conditions outlined in the Franchise Agreement. This usage is specifically for operating the Franchised Business and for approved advertising related to it. You do not gain any ownership or title to any of the Intellectual Property itself.

This means that while you can utilize the provided materials to run your franchise, you cannot reproduce, distribute, or create derivative works from them without explicit permission from Crawlspace Medic. Any goodwill generated from your use of the Intellectual Property benefits Crawlspace Medic, LLC. Upon termination of the franchise agreement, your right to use the Intellectual Property ceases, and no monetary value is assigned to any goodwill you may have built using it.
