How is the 'Location' of a Crave Cookies franchise determined if it's not stated on the Summary Page?

  • "Location" means the location stated on the Summary Page.

If no location is stated on the Summary Page, then the Location will be determined in accordance with Section 6.1.

ARTICLE 6. LOCATION, DEVELOPMENT, AND OPENING

  • 6.1 Determining Location and Territory. If the Location and Territory are not stated on the Summary Page:

  • (i) Franchisee shall find a potential Location within the Development Area described on the Summary Page.

Franchisee shall submit its proposed Location to Crave Cookies Franchising for acceptance, with all related information Crave Cookies Franchising may request.

If Crave Cookies Franchising does not accept the proposed Location in writing within 30 days, then it is deemed rejected.

  • (ii) When Crave Cookies Franchising accepts the Location, it will issue a Location Acceptance Letter in the form of Attachment 2 which states the Location and Territory.

Crave Cookies Franchising shall determine the Territory in its good faith discretion, substantially in accordance with Item 12 of the Franchise Disclosure Document.

If Crave Cookies Franchising fails to state the Territory in writing within 60 days after Franchisee opens the Business to the public, the Territory will be deemed to be the zip codes immediately surrounding the location of the franchised business which comprise 75,000 people.

  • (iii) Crave Cookies Franchising's advice regarding or acceptance of a site is not a representation or warranty that the Business will be successful, and Crave Cookies Franchising has no liability to Franchisee with respect to the location of the Business.

According to Crave Cookies's 2025 Franchise Disclosure Document, if the location is not specified on the Summary Page, the determination of the location follows Section 6.1 of the franchise agreement. The franchisee is responsible for finding a potential location within the Development Area outlined on the Summary Page and submitting it to Crave Cookies for approval, along with any related information requested by Crave Cookies. Crave Cookies has 30 days to either accept or reject the proposed location in writing; failure to respond within this timeframe results in automatic rejection. Upon acceptance of the location, Crave Cookies will issue a Location Acceptance Letter, which officially states the location and territory.

Crave Cookies determines the territory in its good faith discretion, substantially in accordance with Item 12 of the Franchise Disclosure Document. If Crave Cookies does not define the territory in writing within 60 days after the franchisee opens for business, the territory will default to the zip codes immediately surrounding the franchise location that comprise 75,000 people.

It is important to note that Crave Cookies's advice or acceptance of a site does not constitute a guarantee of the business's success, and Crave Cookies assumes no liability regarding the location of the business. The franchisee is also responsible for constructing or remodeling the location to meet Crave Cookies's System Standards and must obtain approval for any construction plans before starting work. Crave Cookies may inspect the construction or remodeling progress but is not obligated to do so, and the franchisee cannot rely on Crave Cookies for architectural, engineering, or legal advice during development.
