After the final Franchised Business under your Minimum Performance Schedule has opened, if we believe that it is desirable to establish additional Franchised Businesses within the Development Area, and if you complied with the terms of your Multi-Unit Development Agreement and are in compliance with your Franchise Agreements, we will offer you the right to develop these additional Franchised Businesses. You must exercise this option, in full, within 60 days of our notice to you. If you do not exercise or you decline this right of first refusal, we will have the right to sell these development rights to another multiunit developer or to develop the Restaurants or Food Trucks ourselves.

What This Means (2025 FDD)
According to Crave's 2025 Franchise Disclosure Document, after the final Franchised Business under a multi-unit developer's Minimum Performance Schedule has opened, Crave may offer the developer the right to develop additional Franchised Businesses within their Development Area. This offer is contingent on Crave believing it is desirable to establish additional Franchised Businesses in that area.
The multi-unit developer must have complied with the terms of their Multi-Unit Development Agreement and be in compliance with all Franchise Agreements. If these conditions are met, Crave will offer the developer the first right to develop additional Franchised Businesses.
The multi-unit developer must exercise this option in full within 60 days of Crave's notice. If the developer does not exercise the option or declines it, Crave has the right to sell these development rights to another multi-unit developer or to develop the Restaurants or Food Trucks themselves. This clause ensures that Crave retains control over the development of its brand and can pursue opportunities even if the current developer is unwilling or unable to expand further.
