developed for us, or to designate: (a) computer software programs and accounting system software that you must use in connection with the Computer System ("Required Software"), which you shall install; (b) updates, supplements, modifications, or enhancements to the Required Software, which you shall install; (c) the tangible media upon which you shall record data; and (d) the database file structure of your Computer System.
- 21.1.3 You shall record all sales on computer-based point-of-sale systems approved by us or on such other types of systems as may be designated by us in the Manual or otherwise in writing ("Pointof-Sale Systems"), which shall be deemed part of your Computer System.
- 21.1.4 You shall make, from time to time, such upgrades and other changes to the Computer System and Required Software as we may request in writing (collectively, "Computer Upgrades").
- 21.1.5 You shall comply with all specifications issued by us with respect to the Computer System and the Required Software, and with respect to Computer Upgrades. You shall also afford us unimpeded access to your Computer System and Required Software as we may request, in the manner, form, and at the times requested by us.
- 21.1.6 In addition to the requirements of Article 4, you shall pay all fees, whether to us or to third party vendor(s), and expenses for technology required by this Agreement for operation of the Franchised Business, including but not limited to, all costs related to the Computer System, Required Software, and Computer Upgrades, digital menu displays, internet access, license fees, help desk fees, and licensing or user-based fees.
21.2 Data
We may, from time-to-time, specify in the Manual or otherwise in writing the information that you shall collect and maintain on the Computer System installed at the Franchised Business, and you shall provide to us such reports as we may reasonably request from the data so collected and maintained. All data pertaining to the Franchised Business, and all data created or collected by you in connection with the System, or in connection with your operation of the Franchised Business (including without limitation data pertaining to or otherwise concerning the Franchised Business' customers) or otherwise provided by you (including, without limitation, data uploaded to, or downloaded from your Computer System) is and will be owned exclusively by us, and we will have the right to use such data in any manner that we deem appropriate without compensation to you. Copies and/or originals of such data must be provided to us upon our request. We hereby license use of such data back to you for the term of this Agreement, at no additional cost, solely for your use in connection with the business franchised under this Agreement.
21.3 Privacy
You shall abide by all applicable laws pertaining to privacy of information collected or maintained regarding customers or other individuals ("Privacy") and shall comply with our standards and policies pertaining to Privacy. If there is a conflict between our standards and policies pertaining to Privacy and applicable law, you shall: (a) comply with the requirements of applicable law; (b) immediately give us written notice of said conflict; and (c) promptly and fully cooperate with us and our counsel as we may request to assist us in our determination regarding the most effective way, if any, to meet our standards and policies pertaining to Privacy within the bounds of applicable law.
21.4 Telecommunications
You shall comply with our requirements (as set forth in the Manual or otherwise in writing) with respect to establishing and maintaining telecommunications connections between your Computer System and our Intranet (as defined below), if any, and/or such other computer systems as we may reasonably require.
21.5 Intranet
We may establish a website providing private and secure communications between us, you, franchisees, licensees and other persons and entities as determined by us, in our sole discretion (an "Intranet").

According to Crave's 2025 Franchise Disclosure Document, franchisees must adhere to specific requirements regarding their computer systems and software. Crave has the right to specify the brands, types, makes, and models of computer systems and hardware used in the franchise, including point-of-sale systems, data storage, security systems, printers, and internet access. Crave also has the right to develop, designate, or require specific computer software programs and accounting system software that franchisees must install, along with any updates or modifications. Franchisees are obligated to make upgrades and changes to their computer systems and software as requested by Crave in writing.
Crave franchisees must record all sales on approved computer-based point-of-sale systems or other designated systems. They must also comply with all specifications issued by Crave regarding the computer system, required software, and computer upgrades, and provide unimpeded access to these systems as requested by Crave. Franchisees are responsible for all technology-related fees and expenses, including costs related to the computer system, required software, computer upgrades, digital menu displays, internet access, license fees, and help desk fees.
Furthermore, Crave franchisees must comply with requirements for establishing and maintaining telecommunications connections between their computer system and Crave's intranet or other computer systems. They must also adhere to Crave's requirements for connecting to and utilizing the intranet, which may include the manual, training materials, and management reporting solutions. Franchisees are required to purchase and maintain the necessary computer software and hardware to connect to and use the intranet. Franchisees are prohibited from using Crave's proprietary marks in any email address or domain name without prior written consent and cannot outsource any services related to the computer system or required software without Crave's approval, unless using an approved supplier.
