What This Means (2025 FDD)
According to the 2025 Crave FDD, the specific location for a franchised business is referred to as the "Accepted Location," which is the street address approved by Crave. This location is detailed in Attachment 1 of the franchise agreement once it has been determined and approved. Franchisees are not allowed to operate their Crave business from any location other than the Accepted Location without prior written consent from Crave. Attachment 1 also contains the Designated Territory. If the Accepted Location is a Non-Traditional Site, the franchisee will not receive a Designated Territory.
Under the Development Agreement, multi-unit developers are authorized to establish and operate Crave outlets within a specific Development Area, as outlined in Attachment 2 of the agreement. The Minimum Performance Schedule, detailed in Attachment 1 of the Multi-Unit Development Agreement, sets the timeline for establishing and operating these franchised businesses within the Development Area. The agreement includes the right to select sites for Crave businesses and submit them for approval.
Crave retains the right to operate or franchise Crave businesses outside the Designated Territory, even during the initial term of the agreement. After the agreement terminates or expires, Crave can operate or franchise businesses at any location, including those inside the former Designated Territory. Crave also has the right to operate or franchise other types of restaurants or distribution models that are not dedicated Crave Restaurants at any location, both during and after the initial term. These stipulations ensure that Crave maintains flexibility in its business operations and expansion strategies, while the franchisee's rights are primarily limited to the Accepted Location and, if applicable, the Designated Territory.
