What This Means (2025 FDD)
According to Crave's 2025 Franchise Disclosure Document, the Multi-Unit Development Agreement does not grant any rights to use Crave's trademarks. The Franchise Agreement, however, does grant the franchisee the right to use trademarks, trade names, service marks, symbols, emblems, logos, and indicia of origin designated by Crave. These marks can only be used in a manner authorized by Crave for the operation of the franchised business.
Crave's franchisees cannot use the marks as part of their corporate or legal name and must comply with Crave's instructions for trade name or fictitious name registrations. Franchisees must also sign documents required to protect the marks or maintain their validity and enforceability, and they cannot contest the validity of Crave's ownership of the marks.
Crave retains rights in the marks, including the right to grant other licenses for their use, develop other systems using the marks, and engage in the production, distribution, and sale of products and services using the marks. The license to use the marks granted in the Franchise Agreement is non-exclusive.
Crave will indemnify franchisees against damages for which they are held liable for their use of any of the marks, provided that their conduct and use of the marks fully complies with the terms of the Franchise Agreement. Franchisees must immediately notify Crave of any apparent infringement of the marks or challenges to their use. Crave has the right to control any litigation or proceedings related to the marks, and franchisees must sign documents necessary to protect Crave's interests.
