What This Means (2025 FDD)
According to Crave's 2025 Franchise Disclosure Document, prior to opening the Franchised Business, and before any renovation to the Franchised Business, a franchisee must execute an Americans with Disabilities Act Certification. This certification, in the form attached to the Franchise Agreement as Attachment 7, confirms in writing to Crave that the Franchised Business premises and any proposed renovations comply with the Americans with Disabilities Act.
This requirement ensures that all Crave locations meet the necessary accessibility standards, protecting both the brand and its customers. By signing the certification, the franchisee acknowledges their responsibility for compliance with ADA regulations. This also means the franchisee is responsible for any costs associated with ensuring compliance, both initially and during any renovations.
The franchisee also acknowledges that they are an independent licensee and the requirement of this certification by Franchisee does not constitute ownership, control, leasing or operation of the Franchised Business. Furthermore, the franchisee acknowledges their obligation under the Franchise Agreement to indemnify the officers, directors, and employees of Crave in connection with any and all claims, losses, costs, expenses, liabilities, compliance costs, and damages incurred by the indemnified party(ies) as a result of any matters associated with the franchisee's compliance with the Americans with Disabilities Act, as well as the costs, including attorneys' fees, related to the same.
It is important for prospective Crave franchisees to carefully review Attachment 7 to fully understand the scope of the certification and their obligations under the Americans with Disabilities Act. They should also consult with legal counsel to ensure they are fully aware of their responsibilities and potential liabilities.
