ITEM 12 TERRITORY
Franchise Agreement: Your Franchise Agreement will specify the site that will be the "Accepted Location" for your Restaurant. Your Franchise Agreement will also specify a designated territory for the Restaurant. The "Designated Territory" will be a five-mile radius around the Accepted Location, except that if your Accepted Location is a Non-Traditional Site (as described below), you will not receive a Designated Territory. In addition, because we have the right to establish Restaurants at Non-Traditional Sites, or to operate Food Trucks at Non-Traditional Sites (which may be within your Designated Territory), your Designated Territory is not exclusive to you. If you do not yet have an Accepted Location at the signing of the Franchise Agreement, you will receive a non-exclusive site search area listed in Attachment 1 of the Franchise Agreement instead.

What This Means (2025 FDD)
According to Crave's 2025 Franchise Disclosure Document, the specific site designated as the 'Accepted Location' for your Crave restaurant will be detailed in your Franchise Agreement. In addition to specifying the Accepted Location, the Franchise Agreement will also outline a Designated Territory for the restaurant, typically a five-mile radius around the Accepted Location.
However, if the Accepted Location is classified as a Non-Traditional Site, you will not receive a Designated Territory. Non-Traditional Sites include locations such as gas stations, convenience stores, transportation facilities, military bases, sports facilities, amusement parks, educational facilities, hospitals, hotels, and casinos. Furthermore, even if you do have a Designated Territory, it is not exclusive, as Crave retains the right to establish restaurants or food trucks at Non-Traditional Sites within your territory.
If you do not have an Accepted Location determined when you sign the Franchise Agreement, you will instead receive a non-exclusive site search area, which will be listed in Attachment 1 of the Franchise Agreement. This allows you time to find a suitable location that meets Crave's criteria, although the responsibility to locate and prepare a suitable site rests solely with you. Note that your restaurant or food truck cannot be relocated outside of your Designated Territory without Crave's prior written consent, and relocation may require signing a new Franchise Agreement and paying a relocation fee.
