  • 1.2 Territory. During the Initial Term and any Successor Term (as such terms are defined below), neither Franchisor nor its Affiliates will own, operate or franchise a fixed location for the operation of any other Franchised Business within Franchisee's territory ("Territory") as set forth in Attachment A to this Agreement. For purposes of this Agreement, "Affiliate" means any person or entity that controls, is controlled by, or is in common control with, Franchisor or Franchisee.

What This Means (2025 FDD)

According to Craters & Freighters' 2025 Franchise Disclosure Document, the franchisee's territory is defined in Attachment A of the franchise agreement. The agreement grants a non-exclusive license to operate a Craters & Freighters franchise at an approved location.

The franchisor and its affiliates will not operate or franchise another fixed-location Craters & Freighters business within the franchisee's designated territory during the initial or any subsequent term. An affiliate is defined as any entity controlled by, controlling, or under common control with the franchisor or franchisee.

The franchisee is expected to focus on attracting and serving customers within their territory but isn't required to verify their location. Craters & Freighters retains the right to market within the franchisee's territory. Customers have the freedom to choose any Craters & Freighters outlet, even outside the franchisee's territory. The franchisee may also get the chance to service adjacent, unsold territories at the franchisor's discretion.
