What This Means (2024 FDD)

According to Crab N Spice's 2024 Franchise Disclosure Document, Section 2.4 of the franchise agreement outlines the role and requirements of the Principal Executive. The Principal Executive is the person primarily responsible for the Crab N Spice business and must have decision-making authority.

While the Principal Executive doesn't need to be the day-to-day general manager, they must devote substantial time and attention to the business. This indicates that Crab N Spice expects active involvement from the owner or a designated executive in overseeing the franchise. The Principal Executive must also maintain at least a 10% ownership interest in the franchise.

The franchise agreement also stipulates that if the Principal Executive's role changes due to death, incapacitation, transfer of interest, or other reasons, the franchisee must promptly designate a new Principal Executive, subject to Crab N Spice's approval. This ensures continuity in leadership and accountability within the franchise operation. Additionally, Section 13.4 addresses the general manager and key employees, stating that if requested by Crab N Spice, the franchisee will ensure that their general manager and other key employees sign Crab N Spice's confidentiality and non-compete agreement.
