What This Means (2024 FDD)
According to Crab N Spice's 2024 Franchise Disclosure Document, the Guarantor waives several rights and defenses related to the guaranty of the Franchise Agreement. Specifically, the Guarantor waives any and all other notices and legal or equitable defenses to which the Guarantor may be entitled.
This waiver means the Guarantor gives up the right to assert various legal arguments or defenses they might otherwise have against Crab N Spice. This could include defenses related to the validity of the underlying debt, the way Crab N Spice is pursuing collection, or other legal claims that could reduce or eliminate the Guarantor's obligation.
For a prospective Crab N Spice franchisee, this is a significant consideration. If a potential guarantor is asked to sign such an agreement, they should fully understand the implications of waiving these rights and defenses. It is advisable to seek legal counsel to fully understand the scope of the waiver and the potential risks involved before signing the Guaranty.
