Crab_N_Spice Franchise · 2024 FDDAnswer from 2024 FDD Document
If we and you cannot agree on a site, you will be unable to comply with your obligation to develop and open the franchise by the deadline stated in the franchise agreement.
Unless we agree to extend the deadline, you will be in default and we may terminate your franchise agreement.

What This Means (2024 FDD)
According to Crab N Spice's 2024 Franchise Disclosure Document, if the franchisee and franchisor cannot agree on a site, the franchisee will not be able to meet the deadline for developing and opening the franchise as stated in the franchise agreement. However, Crab N Spice may agree to extend the deadline. If Crab N Spice does not agree to extend the deadline, the franchisee will be in default and Crab N Spice may terminate the franchise agreement.
This means that a prospective Crab N Spice franchisee's ability to open their franchise on time is heavily dependent on finding a mutually agreeable location. The FDD indicates that the typical time to open a Crab N Spice franchise is 6-8 months after signing the franchise agreement, but this timeline can be affected by factors like securing a lease, obtaining financing and permits, developing the location, and hiring employees.
It is important for potential Crab N Spice franchisees to proactively communicate with the franchisor during the site selection process. If challenges arise that could delay the opening, franchisees should immediately request a deadline extension in writing. The franchisor's willingness to grant an extension is not guaranteed, so franchisees should factor this risk into their planning and financial projections. Franchisees should also clarify the specific conditions under which an extension might be granted to avoid potential default and termination of the franchise agreement.
