What This Means (2024 FDD)
According to Crab N Spice's 2024 Franchise Disclosure Document, CNS Franchising offers assistance to franchisees in hiring and training employees, but the franchisee maintains sole responsibility for all hiring decisions and employment conditions. Specifically, CNS Franchising provides suggested staffing levels and hiring guidelines, as well as training programs for new employees. However, the ultimate authority for hiring and managing employees rests with the franchisee.
This arrangement is typical in franchising, where the franchisee operates as an independent business owner. While the franchisor provides guidance and support, the franchisee is responsible for the day-to-day management of their business, including employment matters. This structure helps to avoid potential joint employer liability, where both the franchisor and franchisee could be held responsible for employment-related issues.
For a prospective Crab N Spice franchisee, this means they have the autonomy to make their own hiring decisions and set their own employment terms. However, it also means they bear the full responsibility for complying with all applicable employment laws and regulations. Franchisees should consult with legal counsel to ensure they understand their obligations as an employer.
