Can Cr3 American Exteriors modify the provisions of the Manual without the franchisee's consent?

5.1. Operation Manuals
We provide you access to our proprietary and confidential operations manual, a franchisee dashboard or portal, as well as any other manuals and writings prepared by us for your use in operating a Franchised Business (collectively, the "Manuals"). We may disseminate the Manuals electronically.
5.2. Modifications
We may modify the Manuals to adjust for competitive changes, technological advancements, legal requirements, and continuous improvement. You will implement those changes as if they were present when you signed this Agreement.
5.3. Site Selection
We do not provide site selection services. However, we may give advice regarding site selection. You will need to lease approximately 1,000 -1,500 square feet of separate commercial office/warehouse or flex space for your equipment, supplies, and inventory.

What This Means (2025 FDD)
According to the 2025 Cr3 American Exteriors Franchise Disclosure Document, Cr3 American Exteriors has the authority to modify the operations manuals. These modifications can address competitive changes, technological advancements, legal requirements, and aim for continuous improvement.
As a franchisee, you are obligated to implement these changes as if they were already in effect when you signed the Franchise Agreement. This means that Cr3 American Exteriors can unilaterally update the operational guidelines, and franchisees must adapt to these changes to maintain compliance with the franchise standards.
Cr3 American Exteriors also has the right to vary standards or specifications for any franchisee based on the franchisee's qualifications, site peculiarities, trade area demographics, business potential, existing business practices, or any other condition they deem important for the franchised business's success. However, Cr3 American Exteriors is not required to grant similar variances to other franchisees.
