Where will arbitration take place for Claims involving Cr3 American Exteriors?

According to Cr3 American Exteriors's 2025 Franchise Disclosure Document, if a matter cannot be resolved through mediation, it will be resolved through arbitration. The arbitration will be conducted following the Commercial Arbitration Rules of the American Arbitration Association (AAA) before a single arbitrator selected by the AAA. The location for the arbitration will be in the city or county where Cr3 American Exteriors's corporate headquarters are located at the time of the hearing.

This means that a Cr3 American Exteriors franchisee may be required to travel to the city or county where the corporate headquarters are located to attend the arbitration hearing. As of April 30, 2025, the franchisor's address is 780 Lynnhaven Parkway, Suite 240, Virginia Beach, VA 23452. Franchisees should be aware that the location of the corporate headquarters, and therefore the arbitration, could change during the term of their Franchise Agreement.

The FDD also stipulates that the franchisee's attorney must include a budget estimating legal fees, witnesses, experts, and documents necessary to establish liability and damages in the demand for arbitration. The arbitrator must approve this budget before any discovery or hearings are conducted, and any increases to the budget must also be approved by the arbitrator. Each party will bear their own costs, including attorney's fees and expert witness fees, while the costs of the mediator or arbitrator, other than initiation fees, will be shared equally among the parties.
