Is Counselor Realty obligated to provide any specific non-technology related tools?

Counselor may also provide you with or require you to utilize such non-technology related tools and services relating to the franchised business as Counselor determines from time to time in its sole discretion. Counselor will not be obligated to provide you with any such non-technology related tools or services, and reserves the right to discontinue providing any such non-technology related tools and services that Counselor may decide to provide at any time. Counselor also reserves the right to modify the terms and conditions regarding any such non-technology related tools and services that Counselor may decide to provide at any time. You will be obligated to pay Counselor fees associated with such non-technology related tools and services that Counselor decides to provide in such amounts, and at such times, as Counselor shall determine from time to time in its sole discretion.

What This Means (2025 FDD)
According to the 2025 Counselor Realty FDD, Counselor Realty is not obligated to provide franchisees with any specific non-technology related tools or services. While Counselor Realty may choose to offer such tools and services at its discretion, it is not required to do so. Furthermore, Counselor Realty retains the right to discontinue providing any non-technology related tools or services it may have previously offered.
Counselor Realty also reserves the right to modify the terms and conditions associated with any non-technology related tools and services it decides to provide. If Counselor Realty does provide these tools and services, franchisees are obligated to pay associated fees in amounts and at times determined by Counselor Realty.
This policy gives Counselor Realty significant flexibility in determining what, if any, non-technology related resources it will provide to franchisees. It also means that franchisees must be prepared to potentially cover the costs of these tools and services themselves if Counselor Realty chooses not to provide them or decides to discontinue them. Prospective franchisees should inquire about what specific non-technology related tools and services Counselor Realty typically provides and what costs are associated with them.
