What happens if there is more than one Counselor Realty franchisee in the same region?

Counselor_Realty Franchise · 2025 FDD

Answer from 2025 FDD Document

Leads created off Counselor Realty, Inc.'s website for listings in the region where your franchised office is located will be provided and directed to your Office; provided, however, that if the lead is for a listing that is listed by one of our franchisee's agents or one of Counselor Realty, Inc.'s agents, such lead will be directed to such agent, if that agent has elected to create a Counselor Realty web page/subdomain. If there is more than one franchisee in the region (distinct areas served by the same MLS system, or its equivalent), those leads will be shared and/or split between the affected franchisees, as determined by Counselor in its sole discretion. We may take into account office locations, number of agents, types of leads or any other rational means to distribute leads.

What This Means (2025 FDD)

According to Counselor Realty's 2025 Franchise Disclosure Document, if there is more than one franchisee operating in the same region, leads generated from Counselor Realty's website for listings in that region will be shared or split among the affected franchisees. The FDD specifies that a region constitutes distinct areas served by the same Multiple Listing Service (MLS) system, or its equivalent.

The method for sharing or splitting these leads is determined by Counselor Realty at its sole discretion. The company may consider various factors when deciding how to distribute leads, including the office locations, the number of agents at each office, the types of leads, or any other rational means of distribution.

For a prospective franchisee, this means that the number of leads received from the Counselor Realty website may be impacted by the presence of other franchisees in the same MLS area. While the FDD does not specify the exact percentage or formula for lead distribution, it does highlight that Counselor Realty retains the authority to make these decisions based on a variety of factors. A prospective franchisee should inquire about the typical lead distribution process and the factors that Counselor Realty considers to ensure they understand how lead generation will work in their specific market.
