Does Counselor Realty guarantee a certain number of leads to each franchisee?

Leads created off Counselor Realty, Inc.'s website for listings in the region where your franchised office is located will be provided and directed to your Office; provided, however, that if the lead is for a listing that is listed by one of our franchisee's agents or one of Counselor Realty, Inc.'s agents, such lead will be directed to such agent, if that agent has elected to create a Counselor Realty web page/subdomain. If there is more than one franchisee in the region (distinct areas served by the same MLS system, or its equivalent), those leads will be shared and/or split between the affected franchisees, as determined by Counselor in its sole discretion. We may take into account office locations, number of agents, types of leads or any other rational means to distribute leads.

What This Means (2025 FDD)
According to Counselor Realty's 2025 Franchise Disclosure Document, Counselor Realty does not guarantee a specific number of leads to its franchisees. However, leads created from Counselor Realty's website for listings in the region of the franchised office will be directed to that office. There are conditions to this. If the lead is for a listing already represented by an agent of Counselor Realty or one of its franchisees, the lead will be directed to that agent, assuming the agent has a Counselor Realty webpage or subdomain.
If multiple franchisees operate in the same region (defined as areas served by the same MLS system or equivalent), the leads will be shared or split among them. The method of sharing or splitting these leads is determined by Counselor Realty at its discretion. Factors that Counselor Realty may consider include the locations of offices, the number of agents in each office, and the types of leads generated.
This arrangement means that a franchisee's lead generation is dependent on Counselor Realty's website traffic and the location of other franchisees. A new franchisee might receive fewer leads if there are already established agents or multiple franchisees in their region. The allocation of leads is not guaranteed and can change at Counselor Realty's discretion, which introduces an element of uncertainty for franchisees relying on these leads for their business.
