Who determines how leads are shared or split between affected Counselor Realty franchisees?

Counselor_Realty Franchise · 2025 FDD

Answer from 2025 FDD Document

Leads created off Counselor Realty, Inc.'s website for listings in the region where your franchised office is located will be provided and directed to your Office; provided, however, that if the lead is for a listing that is listed by one of our franchisee's agents or one of Counselor Realty, Inc.'s agents, such lead will be directed to such agent, if that agent has elected to create a Counselor Realty web page/subdomain. If there is more than one franchisee in the region (distinct areas served by the same MLS system, or its equivalent), those leads will be shared and/or split between the affected franchisees, as determined by Counselor in its sole discretion. We may take into account office locations, number of agents, types of leads or any other rational means to distribute leads.

What This Means (2025 FDD)

According to Counselor Realty's 2025 Franchise Disclosure Document, Counselor Realty determines how leads are shared or split between franchisees. Specifically, if more than one franchisee operates in the same region, defined as distinct areas served by the same MLS system (or its equivalent), leads created from Counselor Realty's website for listings in that region will be shared or split between the affected franchisees.

The decision on how to share or split these leads is made by Counselor Realty in its sole discretion. The FDD states that Counselor Realty may consider factors such as office locations, the number of agents in each office, the types of leads generated, or any other rational means to distribute the leads.

For a prospective Counselor Realty franchisee, this means that lead distribution is not guaranteed and is subject to Counselor Realty's judgment. While the FDD mentions several factors that Counselor Realty may consider, it does not provide a specific formula or methodology. This introduces an element of uncertainty, as a franchisee's lead flow could vary depending on Counselor Realty's assessment and adjustments over time.

Therefore, a prospective franchisee should inquire about Counselor Realty's specific policies and practices for lead distribution in their target region. Understanding how Counselor Realty has historically distributed leads and the relative importance of the various factors they consider can help a franchisee better anticipate their potential lead flow and assess the overall attractiveness of the franchise opportunity.
