What This Means (2025 FDD)
According to Counselor Realty's 2025 Franchise Disclosure Document, Counselor Realty retains the right to modify or end any program or promotion linked to its trademarks. Additionally, Counselor Realty can add, change, or remove trademarks from the list of licensed marks provided to franchisees. This means that franchisees must stay updated on any changes to the marketing programs or the approved trademarks they are allowed to use.
This flexibility allows Counselor Realty to adapt its branding and marketing strategies as needed. However, it also introduces a degree of uncertainty for franchisees. For example, a franchisee might invest time and resources in a particular marketing campaign that is later discontinued by Counselor Realty. Similarly, the removal of a familiar trademark could potentially affect a franchisee's marketing efforts and brand recognition in their local market.
While such changes are within Counselor Realty's rights, it's important for prospective franchisees to understand the potential impact on their business. It would be prudent to inquire about the frequency and nature of past changes to marketing programs and trademarks. Understanding Counselor Realty's historical practices can provide insight into how these rights might be exercised in the future and allow a franchisee to better prepare for and adapt to such changes.
