What This Means (2025 FDD)

According to the 2025 Costa Vida Fresh Mexican Grill Franchise Agreement, Exhibit G is the Site Selection Addendum. If a site has not yet been selected and approved as of the date of the Franchise Agreement, the franchisee must sign and comply with the Site Selection Addendum. Once a site is selected and approved, it will be deemed the "Premises" for the purposes of the agreement.

The Site Selection Addendum is an important part of the franchise agreement because it outlines the process for selecting a location for the Costa Vida Fresh Mexican Grill restaurant. The franchisor must approve the site selected by the franchisee. This ensures that the location meets the brand's standards and has the potential to be successful.

Furthermore, during the initial term of the agreement, Costa Vida Fresh Mexican Grill will not operate or grant another person the right to operate a Costa Vida Restaurant within one mile of the Premises, or as otherwise defined in the Site Selection Addendum attached as Exhibit G. This provides the franchisee with a protected area in which to operate their restaurant. However, Costa Vida Fresh Mexican Grill retains the right to operate or grant others the right to operate Costa Vida Restaurants within the Protected Area in locations such as retail outlets, grocery stores, transportation facilities, colleges, universities, sports arenas, and entertainment facilities.
