What This Means (2025 FDD)
According to Cordova's 2025 Franchise Disclosure Document, the California Franchise Agreement Amendment aims to protect franchisees by preventing them from waiving rights granted under California franchise law. Specifically, it ensures that franchisees cannot waive claims related to state franchise law, including claims of fraud in the inducement.
Additionally, the amendment prevents franchisees from disclaiming reliance on statements made by Cordova, its franchise sellers, or other representatives. This means that franchisees can hold Cordova accountable for representations made during the franchise sales process.
This provision is designed to supersede any conflicting terms in other documents executed in connection with the franchise agreement, reinforcing the protection afforded to franchisees under California law. By including this amendment, Cordova is ensuring compliance with California franchise regulations and providing greater legal security for franchisees operating in the state.
