What This Means (2025 FDD)
According to Cool Binz's 2025 Franchise Disclosure Document, a franchisee can cease operating the business without facing automatic termination if the cessation is due to an act of God or other circumstance beyond their control, as determined by Cool Binz. This exception applies as long as the period of inactivity does not exceed five consecutive days. Additionally, the business telephone must remain connected, with a new number immediately reinstalled or reconnected if necessary.
This provision protects Cool Binz franchisees from immediate termination in situations where unforeseen events, such as natural disasters or other emergencies, temporarily prevent them from running their business. However, the franchisor retains the discretion to determine whether the circumstances truly qualify as being beyond the franchisee's control.
It is important for prospective Cool Binz franchisees to understand the scope of this exception and what types of events would be considered 'beyond your control' by Cool Binz. Maintaining clear communication with the franchisor during any period of operational disruption is crucial to avoid potential disputes or termination.
