What are the training requirements for the Cool Binz Managing Owner or Designated General Manager each year?

and you will be responsible for the payment of all travel and living expenses incurred by your designees while training.

The Managing Owner or, if applicable, the Designated General Manager, must attend the COOL BINZ convention every year it is offered. If you fail to attend the Convention, without our prior written permission, you must pay the Convention Non-Attendance Fee of $1,000. The Managing Owner or, if applicable, Designated General Manager also must attend periodic refresher training courses and conferences, not to exceed one (1) convention/conference per year, at the times and locations we determine, and for which we may charge fees. We will determine the duration, curriculum, and location of any such sessions. You will be responsible for all travel and living expenses that are incurred by you or your employees/owners while attending such session.

In the event that the Designated General Manager terminates their employment with you, you are required to designate a successor for our written approval, which we will grant in our sole discretion, within ten (10) days of such termination. Such successor Designated General Manager must attend the next available Business Manager and Technical Operations Training. In the event, that the successor Designated General Manager does not successfully complete the next available Business Manager and Technical Operations Training, you may appoint one (1) additional person as the successor Designated General Manager. This second successor Designated General Manager must attend and successfully complete the next available Business Manager and Technical Operations Training. If this second successor Designated General Manager does not successfully complete the next available Business Manager and Technical Operations Training, you will be in default of this Agreement and this Agreement will be subject to termination pursuant to Section 12 of this Agreement. At all times during the term of this Agreement, you must have employed at the COOL BINZ Business a person who has completed the Business Manager and Technical Operations Training program.

If this is a Renewal Term or if this is an additional COOL BINZ Business being awarded to you, and your Managing Owner or, if applicable, the Designated General Manager, have already attended Business Manager and Technical Operations Training, the requirement that you attend the Business Manager and Technical Operations Training is waived, except as described above with respect to the online training modules and continuing training obligations. In such cases, if your Managing Owner or, if applicable, the Designated General Manager do attend Business Manager and Technical Operations Training, you will be assessed our then-current training fee.

According to Cool Binz's 2025 Franchise Disclosure Document, the Managing Owner or Designated General Manager must attend the Cool Binz convention every year it is offered. If they fail to attend without prior written permission, they must pay a Convention Non-Attendance Fee of $1,000. They also must attend periodic refresher training courses and conferences, but not more than one convention/conference per year. Cool Binz determines the times and locations for these events and may charge fees for them.

The Managing Owner or Designated General Manager must also complete the Business Manager and Technical Operations Training to Cool Binz's satisfaction. This training lasts up to four days and is held in Naples, FL, or another location Cool Binz designates. Franchisees are responsible for travel and living expenses incurred during this training. However, Cool Binz may waive the Business Manager and Technical Operations Training if the franchisee already operates a Cool Binz Business and purchases an additional franchise. Even if the Business Manager and Technical Operations Training is waived, the Managing Owner will still be required to successfully complete the most recent online training modules essential to the role of ownership.

If a Designated General Manager leaves their position, a successor must be appointed within ten days and attend the next available Business Manager and Technical Operations Training. Failure of the successor to complete this training can lead to the termination of the franchise agreement. At all times during the term of the Franchise Agreement, the franchisee must have employed at the Cool Binz Business a person who has completed the Business Manager and Technical Operations Training program.

Prospective franchisees should note that Cool Binz retains discretion over the content, location, and fees associated with refresher training. The $1,000 non-attendance fee for the annual convention could also represent a significant cost if attendance is missed without prior approval. The requirement to have a trained individual employed at all times also means that franchisees must plan for potential staff turnover to avoid being in default of the Franchise Agreement.
