Does Cool Binz have the right to formulate and design the content of advertising materials?

According to Cool Binz's 2025 Franchise Disclosure Document, Cool Binz retains significant control over the content and design of advertising materials used by franchisees. Cool Binz has the right to formulate and design the content of advertising materials and may discontinue materials if they determine a more effective alternative. Any other forms of advertising must be approved by Cool Binz in writing.

This means that as a Cool Binz franchisee, you must adhere to Cool Binz's standards and obtain approval for any advertising materials you wish to use beyond what they provide. Cool Binz can also require you to discontinue using certain advertising materials, even if previously approved. This ensures brand consistency but limits your creative control over local marketing efforts.

Cool Binz also requires franchisees to spend a minimum percentage of gross sales on local advertising: 10% until the fleet is 80% rented, then 5% after that. These funds must be spent on approved advertising and marketing materials. Cool Binz also has established a Brand Marketing Fund where franchisees must contribute 2% of gross sales monthly. Cool Binz has sole discretion over how these funds are spent on advertising and marketing programs.

Franchisees are also required to use a customized website connected to Cool Binz's website, with Cool Binz retaining sole discretion and control over the website's timing, design, contents, and continuation. Franchisees must also obtain prior written approval of the content to be posted on social media pages related to the Cool Binz Business.
